ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

In consideration of myself, ‘player I have signed up through this registration platform’, and any “relationships listed on this registration platform’ being allowed to participate in any Crossman Basketball Programs, Training, and Workouts, or any other related activities (“Programs”) provided by Crossman Basketball undersigned acknowledges, appreciates, and agree that: The risk of injury from the activities involved in these Programs is significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of Crossman Basketball and any facilities used, their officers, officials, agents, representatives, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, (“Releases”), or others, and assume full responsibility for my participation. I, for myself and on behalf of any of heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless releases with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the releases or otherwise, to the fullest extent permitted by law. I, for myself and on behalf of any of heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless all of the above releases from any and all liabilities incident to my involvement or participation in these programs, even if arising from their negligence to the fullest extent permitted by law. I grant permission for the camp directors to act on my behalf in case of medical emergency. I understand that I am responsible for all medical expenses. I also grant permission for my child to appear in program photos or video highlights.

In consideration of my participation, I agree to the following:
(A) I waive, release, and discharge Rey Crossman Basketball from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity.
(B) Indemnify, hold harmless, and promise not to sue the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which I may participate.

I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns.

COVID 19 RELEASE WAIVER AND LIABILITY AGREEMENT

Section 1. General Release
By signing this agreement, you hereby release and discharge Crossman Basketball, from any and all claims, causes of action or liability for any injuries that you or your child(ren) may suffer resulting from participation in an Crossman Basketball sponsored event or workout, or through the use of Crossman Basketball facilities, whether or not the claims, causes of action or liability arise out of, or result from, any act, omission, or conduct of any of Crossman Basketball employees, representatives, contractors, vendors, volunteers, agents, owners, investors, other program participants or their families, (hereinafter “Rey Crossman Basketball Parties”).

Section 2. Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly through person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Crossman Basketball has put in place preventative measures to reduce the spread of COVID-19, however, Crossman Basketball cannot guarantee that you and/or your child(ren) (or other family members) will not become infected with COVID-19. Further, attending a Crossman Basketball facility or anCrossman Basketball sponsored activity could increase your risk and/or your child(ren)’s (or other family member’s) risk of contracting COVID-19. By signing this agreement, you acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you and/or your child(ren) and other members of your family may be exposed to or infected by COVID-19 by attending the facilities of Crossman Basketball or through attendance at other Crossman Basketball sponsored activities and that such exposure or infection may result in personal injury, illness, permanent disability, or death. You also understand that the risk of becoming exposed to or infected by COVID-19 may result from the actions, omissions, or negligence of Crossman Basketball Parties.

By signing this agreement, you also voluntarily agree to assume all of the foregoing risks, including financial risks, and accept sole responsibility for any injury to yourself and/or your child(ren) (or other family members) including, but not limited to, personal injury, disability, death, illness, damage, loss, liability, or expense, of any kind, that you or your child(ren) (or other family members) may experience or incur in connection with your own or your child(ren)’s attendance at Crossman Basketball facilities or through participation in Crossman Basketball sponsored programming (“Potential Claim”). On your behalf and on behalf of your children (and other family members), you hereby release, covenant not to sue, discharge, and hold harmless Crossman Basketball and Crossman Basketball Parties, collectively and individually, from all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to a Potential Claim. You understand and agree that this release includes any Potential Claim based on the actions, omissions, or negligence of Crossman Basketball or Crossman Basketball Parties, whether a COVID-19 infection occurs before, during, or after participation in any Crossman Basketball program or at a Crossman Basketball facility.
